1. Introduction

These Terms & Conditions govern the use of the ToeFu.lab website and the purchase of our products. By accessing our site or placing an order, you enter a legally binding contract. If you do not agree to these precise terms, you are prohibited from using this website.

2. Products, "Free-Size" Specifications & Risk

  • Free-Size Acknowledgement: All socks are sold as "Free-Size." By purchasing, the customer acknowledges that "Free-Size" is a specific product description and that "poor fit" or "unsuitability" does not constitute a product fault.

  • Foreseeable Risk Prevention: The customer assumes all risks regarding the suitability of "Free-Size" garments for their specific physical requirements. ToeFu.lab is not liable for any discomfort or injury resulting from the use of socks on feet outside of standard adult size ranges.

  • Variations: We do not guarantee that your screen’s display of colours will accurately reflect the product. Minor variations are a foreseeable part of the manufacturing process.

3. Pricing, Payments & Errors

  • Price Changes: We reserve the right to adjust pricing at any time.

  • Mistake Correction: In the event of a pricing or discount error, we reserve the right to cancel the order. You acknowledge that no "loss of bargain" claims can be made against us for such cancellations.

4. Order Acceptance & Mandatory Procedural Cancellation

We reserve the right to refuse any order. If we cancel an order after payment, our liability is strictly limited to a refund of the amount paid.

5. Shipping & Limitation of Transit Risk

  • Estimated Timelines: Delivery dates are non-binding estimates. Time is not "of the essence" in these contracts.

  • Risk Transfer: Pursuant to UK law, risk passes to the consumer upon delivery. Any delivery discrepancies or "non-receipt" claims must be reported within 7 days; failure to do so constitutes an absolute waiver of any claim against ToeFu.lab for that shipment.

6. Strict Returns & Hygiene Protocol 

  • Hygiene Exemption: Under Regulation 28(3)(a) of the Consumer Contracts Regulations 2013, socks are exempt from return rights if the hygiene seal or packaging is tampered with.

  • The "Opened" Policy: By opening the product packaging, you provide express acknowledgement that the item is no longer in a resalable condition. Opened socks will not be refunded.

  • Forensic Inspection: All returns are inspected for lint, skin cells, or stretching. If an item is rejected, the customer must pay a Return Shipping Fee to have the item sent back to them; otherwise, the item will be destroyed after 14 days.

7. Limitation of Liability & Foreseeable Damages

  • Total Cap: To the fullest extent permitted by law, ToeFu.lab’s total liability for any claim shall not exceed the purchase price of the specific product.

  • Exclusion of Consequential Loss: We are not liable for any loss of profit, loss of business, or any indirect or "consequential" losses that were not foreseeable at the time of purchase.

  • Statutory Rights: Nothing in these terms excludes our liability for death or personal injury caused by our negligence, as required by the Consumer Rights Act 2015.

8. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
